Terms of Service

Effective Date: December 19, 2025

1. Agreement to Terms

By accessing and using DistressNow (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. User Eligibility

You must be at least 18 years old and a resident of Nigeria to use DistressNow. By using the Service, you represent and warrant that you meet these requirements. We reserve the right to terminate accounts of users who do not meet these criteria.

3. Account Creation & Responsibility

3.1 Account Registration

You are responsible for maintaining the confidentiality of your password and account information. You agree to accept responsibility for all activities that occur under your account. You agree to immediately notify DistressNow of any unauthorized use of your account.

3.2 Accurate Information

You agree to provide accurate, current, and complete information during registration and maintain and promptly update this information to keep it accurate, current, and complete.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited conduct:

  • Fraudulent transactions or false listings
  • Harassment, threats, abuse, or hateful conduct toward other users
  • Uploading illegal, abusive, or obscene content
  • Intellectual property infringement or copyright violation
  • Circumventing security measures or unauthorized system access
  • Spamming, phishing, or malware distribution
  • Misrepresenting identity or credentials
  • Money laundering, drug trafficking, or illegal activities
  • Circumventing payment mechanisms to avoid fees
  • Selling stolen goods or counterfeit products
  • Sharing adult or explicit content
  • Violating any applicable laws or regulations

5. Listings & Transactions

5.1 Seller Responsibilities

Sellers warrant that they have the right to sell the items listed and that all descriptions are accurate and complete. Sellers are responsible for setting fair prices and ensuring compliance with all applicable laws.

5.2 Buyer Responsibilities

Buyers are responsible for inspecting items before purchase and are encouraged to verify authenticity and condition. Buyers should only complete payment after in-person inspection unless explicitly stated otherwise.

5.3 Meeting & Safety

Users are responsible for their own safety during transactions. DistressNow recommends meeting in public, well-lit locations and never sending payment without inspecting items in person. We are not responsible for disputes arising from transactions.

6. Dispute Resolution & Refunds

6.1 Buyer Protection

While DistressNow encourages safe transactions, we do not guarantee protection for all disputes. Users should resolve disputes directly or through our dispute resolution process.

6.2 Refund Policy

Refunds are determined on a case-by-case basis. DistressNow does not guarantee refunds but will mediate disputes fairly. Service fees are non-refundable.

7. Payment & Fees

7.1 Payment Processing

DistressNow does not directly process payments. All payment transactions are handled by third-party payment processors. By using our Service, you agree to their terms of service.

7.2 Service Fees

DistressNow may charge service fees for premium features. All applicable fees will be disclosed before completion of transactions.

8. Intellectual Property

8.1 Ownership

DistressNow and its original content (including but not limited to text, graphics, logos, images, audio, and video) are owned by DistressNow or its content suppliers and are protected by international copyright laws.

8.2 User Content License

By posting content on DistressNow, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for platform operations.

8.3 Copyright Infringement

If you believe content infringes your copyright, contact us immediately. We will investigate and remove infringing content. Repeated infringement may result in account termination.

9. Disclaimer of Warranties

DistressNow is provided on an "as-is" and "as-available" basis. DistressNow makes no representations or warranties regarding the Service or its content, and disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, DistressNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to damages for lost profits, data, or goodwill.

11. Account Termination

11.1 User Termination

You may terminate your account at any time through your account settings.

11.2 Platform Termination

DistressNow may terminate your account at any time for violation of these Terms, illegal activity, or at our sole discretion. Upon termination, your right to use the Service immediately ceases.

12. Indemnification

You agree to indemnify, defend, and hold harmless DistressNow and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

DistressNow reserves the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Service constitutes acceptance of updated Terms.

14. Governing Law

These Terms and your use of the Service are governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law principles.
